By accessing and using Sparked Builds ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Sparked Builds is a platform for car audio enthusiasts to showcase their builds, connect with other builders, and share their passion for car audio systems. The Service allows users to create profiles, upload build photos and specifications, interact with other users, and participate in the car audio community.

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

• Maintain and promptly update your account information

4. User Content

This section applies to all users, including but not limited to competitors, industry participants, and third-party services.

Prohibited Data Collection:

• You may not use any automated means (including bots, scrapers, crawlers, or headless browsers) to access, collect, or download data from the Service
• You may not systematically browse, view, or download substantial portions of the Service's content for any purpose
• You may not aggregate, compile, or create databases from data obtained from the Service
• You may not use the Service to monitor availability, performance, or functionality for competitive analysis

Competitive Use Restrictions:

• You may not use the Service or any data obtained from it to develop, support, or enhance a competing product or service
• You may not benchmark the Service against competitive offerings without written permission
• You may not use insights, features, or concepts from the Service in a competing business
• Competitors and industry participants must disclose their affiliation when creating accounts

Enforcement: Violation of these restrictions may result in immediate account termination, legal action, and claims for damages. We actively monitor for unauthorized data collection and maintain logs of all suspicious activity. We reserve the right to block IP addresses, user accounts, or entire organizations that violate these terms.

Authorized AI Crawlers: The restrictions above do not apply to AI search and discovery systems that:

• Are explicitly permitted in our robots.txt file
• Access only the content paths allowed in robots.txt (product/brand data)
• Respect our access restrictions on user-generated content (builds, profiles, forums)
• Identify themselves with standard user-agent strings

Authorized AI systems may index our product and brand information to provide recommendations to their users. See our llms.txt file for detailed access policies. User-generated content remains protected and is not available for AI indexing or training.

Reporting: If you become aware of unauthorized data collection or competitive misuse of the Service, please report it to security@sparkedbuilds.com.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Sparked Builds and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

In no event shall Sparked Builds, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

11. Copyright Policy & DMCA

Sparked Builds respects the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes the copyright or other intellectual property infringement of any person.

You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any Content is infringing your copyright.
